1. Trademark Search

Evaluate Results: Assess the search results to avoid potential conflicts and ensure your
trademark has a high chance of registration.
2. Filing the Application
Choose the Appropriate Class: Identify the correct class/classes under which your
goods/services fall according to the NICE classification system.
Prepare the Application: Include details like the applicant’s name, address, type of business,
and a clear representation of the trademark.
Submit the Application: File the application online through the Indian Trademark Registry’s efiling portal or submit it physically at the appropriate Trademark Office.
3. Examination of the Application
Formal Examination: The Trademark Office examines the application to ensure it complies with
the procedural requirements.
Substantive Examination: The office evaluates the distinctiveness of the trademark and checks
for any conflicting marks.
Examination Report: An examination report is issued, highlighting any objections or issues.
4. Response to Examination Report
Address Objections: If the examination report lists objections, you must respond within the
stipulated time (usually 30 days) with appropriate clarifications, documents, or amendments.
Hearing: If necessary, attend a hearing to further defend the application.
5. Publication in Trademark Journal
Advertisement: Once accepted, the trademark is published in the Trademark Journal to allow
for public opposition.
Opposition Period: The public has four months to oppose the trademark registration. If no
opposition is filed or if opposition is resolved in favor of the applicant, the process moves
forward.
6. Registration and Certification
Registration Certificate: If no opposition is received, or if the opposition is decided in favor of
the applicant, the trademark is registered, and a registration certificate is issued.
Trademark Protection: The trademark is now protected for ten years from the date of
application.
